The terms of sale and/or commercial status listed here refer to the rights, obligations, exclusions of guarantee and responsibilities that may apply to the customer.

In different ways, the customer who makes the order at this company site and/or other business channels owned and/or referred to TERRAQUA, declares that he has reviewed, including and accepted in all its parts, all the indications provided to him during the purchase process, the offer of product specifications and the present general conditions in their entirety.

Terms of use and sales

The terms of sale govern the business relationship between the terraQUA company and the author of the order (named Customer), the data of which are indicated in the order registration form and, subsequently submitted, through all the business channels of the aforementioned (online, in-store, etc.). These above conditions are subject to any changes and/or additions by subsequent legal and/or regulatory provisions.

Information cards and product data

The technical information on the site and in the various "product cards" is information in the public domain and/or published by the manufacturers of the catalog products. TERRAQUA reserves the right to modify and/or integrate the information contained in the product cards, also according to what is communicated by authorized manufacturers and/or third parties, even without any notice.

The images on the site are purely indicative and, the object and/or animal may differ slightly in some cases from the image on the site.

Product Availability

The customer can only purchase the products on the site and at the time of the order submission. Since access to the site is simultaneous, this mode allows you to automatically change the availability of a given product. If the quantity of product exceeds the quantity available in stock at the time of the order, the customer will be informed of this possibility, offering the possibility to modify and/or cancel and/or replace what was ordered. In the case of products and/or animals not available (Bookable to order), the customer will be informed of delivery and/or waiting times, normally no more than 10 days. For products and/or animals referred to as "Ready Delivery", immediate availability in stock is referred to, with considerably reduced delivery times (usually from 2 to 4 business days)

Prices on the site

The prices entered on the sto are to be understood VAT included (except if otherwise indicated). TERRAQUA reserves the right to change product prices at any time and without any notice. The prices present at the time of the customer's order are those that coincide and are not subject to any changes on the site. All prices shown are in Euro and subject to two decimal places, including taxes.

Refund of the order

In the case of a request for reimbursement of the order, total or partial, the same is done only if the shipment is insured and only by way of payment of the order placed.

It should be noted that, with regard to meal bugs, live animals, frozen food,being goods and/or products sensitive to transport, despite the constant commitment of the carriers with which the company collaborates and compliance with the timing of delivery and packaging used, may happen, albeit very rarely, delays in deliveries and/or loss; in these cases there is no reimbursement for mortality due to delays in deliveries, possible shipping and/or loss because, the above goods, travel under the responsibility of the customer.

In the case of insured goods (with the payment of a small contribution) it will be possible to make a refund request and only for some carriers (indicated in the logistics section) also 100% of the declared value and for orders from 150.00 euros and up (up to a maximum of 500.00 euros insurable value declared and with obvious invoice attached)

They will not be accepted and/or taken into considerations situations other than those mentioned above

Invoice issues and/or attached documents

TERRAQUA issues regular accompanying invoice for all orders placed, with information provided by the customer at the time of the same order and/or through a registration form. The invoice will be sent both by email (digital PDF) and paper, in closed envelope, present in the document to be sent.

With regard to documentation relating to Cites or other, if provided for by the current legislation, it will be included together with the accompanying invoice in paper format in the same file.

Property reserve

TERRAQUA reserves the ownership of the goods provided until the Customer has fulfilled the obligations provided by the above structured, up to the total payment of the order and in its entirety. The above property does not hinder the transfer of the risks related to the order and to the customer from the date of the order until the exit from the warehouses of TERRAQUA.

Right of withdrawal

According to Art. 206 of DL 6/2005 if you are a private consumer, you may exercise your right to withdraw if the goods differ from the goods ordered substantially. In the case of a request to cancel the order (with payment made with amazon pay, PayPal or satispay) the 1% commission will be withheld which is usually withheld from the seller

Corporate Responsibility

TERRAQUA is not responsible for any damage or loss, direct and/or indirect to persons and/or things, arising from the sale and subsequent use of goods and/or services proposed in the catalog published on the site, also for delayed and/or non-delivery of the product nor for any fact not directly attributable to the company. Any liability for shipments made is excluded because, once we leave our warehouses, the brochures and/or shipments are subject to the sole responsibility of the carrier. Any right of the Customer to damages or compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or things and/or animals, caused by the non-acceptance, even partial, of an order, is excluded.

The Customer, once placed the order and accepted the commercial terms at checkout, automatically accepts the terms and outlined above in its entirety, taking full responsibility for both what was purchased and/or ordered and the receipt of the purchased goods (including live there)

These responsibilities are also extended to other forms of purchase agreed, in connection with the site such as social channels and messaging (whatsapp, etc.)

TERRAQUA, does not respond to damage caused by the misuse of products or defects of the products, towards things, people and/or pets and non-pets.

Legislation

The sales agreement between the customer and TERRAQUA is understood to be concluded in Italy and regulated by Italian law. For any civil and/or criminal dispute arising from the confusion of this remote sales agreement, the Forum of responsibility of the municipality of residence or residence of the owner of TERRAQUA is referred to.
